T公司与员工叶某于2005年6月23日签订了《劳动合同书》,期限为1年。合同中约定。双方签订的培训协议作为《劳动合同书》的补充附件,与《劳动合同书》具有同等法律效力。
2006年4月8日,T公司与叶某签订《出国培训协议》,由公司出资,选派叶某去美国培训,培训期限为2006年4月15日至2006年7月15日。协议中约定了服务期限和违约赔偿方式。2006年7月15日后,公司才根据项目建设调整情况延长叶某在美国的培训期限,直至2006年12月23日。但不久,叶某不辞而别且去向不明。为此,T公司申请劳动争议仲裁,要求叶某赔偿2006年4月15日至2006年12月23日在美国的培训费用。仲裁委经过调查认为,双方当事人签订的《劳动合同书》和《出国培训协议》合法有效,T公司提出叶某应按双方约定的培训协议赔偿培训费用,符合《劳动法》第102条“劳动者违反本法规定的条件解除劳动合同或者违反劳动合同中规定的保密事项,对用人单位造成经济损失的,应当依法承担赔偿责任”及原劳动部《关于贯彻执行<中华人民共和国劳动法)若干问题的意见》(劳部发[1995]309号)第33条规定:“劳动者违反劳动法规定或劳动合同的约定解除劳动合同(如擅自离职),给用人单位造成经济损失的,应当承担赔偿责任。”
仲裁委裁决,解除双方劳动合同关系,叶某应赔偿T公司自2006年4月15日至2006年7月15日在美国的培训费用4万美元。T公司虽然胜诉,但是叶某已经逃之夭夭,至今下落不明,叶某需赔偿的培训费用也无着落。
