对委托人而言,生前信托有何意义?

委托人设立生前信托的目的各不相同,一般来说有以下几种:管理财产、处理财产、保全财产和增值财产。(1)、管理财产:委托人由于时间、精力有限,无法亲自管理财产,料理相关事务,便可设立生前委托,将有关事务委托给受托人去办理,减轻委托人的负担。

(2)、处理财产:委托人想转换财产的形式或分配财产,如出售原来的财产,向受益人交付财产等,这就会涉及到财产的出售方式、价格、时间等,还要涉及到相关税收或其它法律问题。

(3)、保全财产:保全财产指委托人通过财产的信托,利用信托财产的独立性,保护其财产。

(4)、增值财产:委托人把财产信托给有丰富理财经验的受托人,由受托人经营,达到增加收益增值财产的目的。

通过个人生前信托业务受托人利用自身的能力和经验及其它优势为委托人管理经营信托财产,既减轻了委托人的负担、解决了委托人的困难,又能提高财产的收益。
