简述对事实认识错误的处理方法。

参考答案:所谓事实认识错误,是指行为人对自己行为时的事实情况有不正确的理解。行为人对自己行为时的事实情况,尤其是对表明犯罪客观要件方面事实情况的认识错误,可能对其刑事责任发生影响。对事实认识错误的处理方法主要包括:
(1)行为人对目标的认识错误。如果行为人对自己行为的社会危害性没有认识,则根据实际情况应当构成过失犯罪或者意外事件。
(2)如果行为人对犯罪对象认识有错误,但是对犯罪客体认识没有错误,则对其刑事责任不发生任何影响。
(3)如果行为人对犯罪对象认识有错误且对犯罪客体的种类认识有错误,则依行为人主观认识的客体种类定罪。
(4)行为人对犯罪手段的认识错误,即行为人对其选择的犯罪手段的性质的认识错误。这种情况不影响罪过的成立。但是,危害结果没有发生的,行为人往往只负犯罪未遂的刑事责任。
(5)行为人对因果关系的认识错误,即行为人对其所实施的行为和所造成的结果之间的因果关系的实际发展有错误认识,该种情况一般不影响对行为人刑事责任的认定。
