17周岁的高中生甲继承其父价值15万元的劳力士手表一块。后未经其母同意将该表以13万元出卖给乙,因甲长得高大魁梧,举止言谈较老成,乙误信其已成年,遂将此表买下。二日后,乙又将此表以13.8万元转卖给不知情的丙。甲母获悉此事后,向乙交涉,认为甲、乙之间的买卖无效;又向丙主张乙无权转卖此表,要求丙将此表还给自己。

参考答案:甲与乙的买卖应认定无效。甲是17周岁的高中生,为未成年人、限制民事行为能力人,依照民法通则的规定,限制民事行为能力人实施与年龄、智力不相适应的民事活动,应当征得其法定代理人的同意,未征得同意且法定代理人拒绝追认的,其行为无效。本案中买卖的标的额较大,与甲的年龄、智力并不相适应,甲的法定的代理人又是明确表示反对的,所以,甲与乙的买卖行为无效。
乙不能主张善意取得。善意取得是指无权处分他人财产的占有人,在将其占有的他人财产不法让于第三人后,如果受让人在取得该财产时系处于善意,即取得该财产的所有权,原财产所有人不得要求受让人返还。其所谓的善意,是指不知道处分人没有处分权,而非不知道处分人无行为能力。此案中乙误信甲有行为能力,不能主张善意取得制度的适用。
