简述民族区域自治与特别行政区自治的区别。

民族区域自治和特别行政区自治都在中华人民共和国范围内,但有所区别。

(1)民族区域自治是在中央政府的统一领导下,是为解决民族问题而实行的;特别行政区则实行“一国两制”,是为祖国统一而实行的。中央对民族自治地方和特别行政区的干预程度不同。

(2)民族区域自治以少数民族聚居区为基础,建立相应的自治地方,行使宪法和法律授予的自治权;特别行政区则实行高度自治,适用于港、澳、台地区,有立法权、行政管理权、独立的司法权和终审权。

(3)民族区域自治依法设立自治机关,行使民族自治权和地方国家机关职权;特别行政区则实行当地人管理,自治程度高于民族区域自治,中央对特别行政区的事务管理得比较少。

(4)民族区域自治施行国家的各项法律、政策,但可以变通执行或停止执行,同时还可以制定自治条例和单行条例;特别行政区所施行的法律自成体系,除特别行政区基本法外,极少数全国性法律在特别行政区实施,其他法律均不在特别行政区实施。
