“钓鱼执法”是指当事人原本没有违法意图，在执法人员的引诱之下，才从事了违法活动，即执法机关通过不正当手段获取当事人违法的证据，并以此对“违法分子”进行行政处罚的执法行为。此种执法方式严重影响了政府行政部门的形象，其危害性巨大。
