(1)拆迁补偿对象。①被拆迁人。拆迁补偿的对象可从“人”的角度进规范,即对什么人进行补偿。房屋作为所有人财产,是所有人经济利益的一部分。拆迁人拆除房屋,使被拆除房屋的所有人遭受经济损失,理应对被拆除房屋的人进行补偿。②标的物。在补偿过程中,不仅要对被拆除的房屋进行补偿,同时还应当对房屋的附属物予以补偿。拆除违章建筑和超过批准期限的临时建筑,不予补偿;拆除未超过批准期限的临时建筑,应当给予适当补偿。

(2)被拆迁人可以选择补偿方式。被拆迁人可以选择货币补偿方式,也可以选择房屋产权调换方式。但有两个例外:一是拆迁非公益事业房屋的附属物,不作产权调换,只能由拆迁入给予货币补偿;二是被拆迁人与房屋承租人对解除租赁关系达不成协议的,拆迁人应当对被拆迁人实行房屋产权调换。

(3)拆迁安置。①安置用房质量和安全要求。拆迁人应当提供符合国家质量和安全标准的房屋,用于拆迁安置。②临时安置补助费。临时安置补助费,是指拆迁人对被拆迁入或者房屋承租人在过渡期内自行过渡可能发生费用的补助,通常又称为过渡费。在过渡期内,被拆迁人或者房屋承租人自行安排住处的,拆迁人应当支付临时安置补助费。临时安置补助费的标准,由省、自治区、直辖市人民政府作出规定。《拆迁条例》规定了对被拆迁人提供周转房的,拆迁人已经解决了被拆迁人临时过渡问题,拆迁人已经履行了为被拆迁人或者房屋承租人承担临时安置的责任,在规定的过渡期内,拆迁人不必付给被拆迁人或者房屋承租人临时安置补助费。
