2000年10月，雷某在当地保险公司购买一份人身意外伤害保险，保险条款规定：保险费支付方式为按年交纳，交费期的下一月为宽限期，宽限期内保险人对被保险人仍负保险责任，但宽限期届满后投保人仍未交付保险费的，保险单自动失效，保险人不负保险责任。保险责任条款中则约定：被保险人在保险合同有效期内因意外事故受伤或死亡的，保险人按保险金额赔偿。投保人雷某同意并签了字，又交纳了第一年的保费。2001年续保。2002年10月，雷某因故没有及时交纳，次月仍未去交。12月初，雷某在出外办事途中遭遇车祸受伤，遂向保险公司申请赔偿保险金。

保险公司在审查后则认为，雷某怠于交纳保险费，并在宽限期之后发生保险事故，此时保险合同效力已经中止，保险公司没有给付其保险金的义务。雷某则认为保险公司应当通知其交纳保险费，并且宽限期过短（一个月），不符合我国保险法关于宽限期为60天的规定，所以保险公司应当理赔。双方争执不下，只得对簿公堂。
