《行政诉讼法》第37条第2款规定,法律、法规规定应当先向行政机关申请复议,对复议不服再向人民法院提起诉讼的,依照法律、法规的规定。依据第38条规定,申请人不服复议决定或复议机关逾期不作决定的,申请人可以提起诉讼。本案为治安行政案件,不属于行政复议前置,同时由于市公安局不受理王某的复议申请,所以王某可以提起诉讼,法院应予受理。
