继续犯,又称持续犯,是指犯罪行为在一定时间内处于继续状态的犯罪。继续犯的特点是不法行为和不法状态同时继续,而不仅仅是犯罪行为所造成的不法状态的继续。某些犯罪,当不法行为终了以后,不法状态仍然可能继续,例如盗窃罪,犯罪分子非法占有赃物这一状态也可能维持相当长的时间,直到赃物起获为止,这就是单纯的不法状态的继续,这在刑法理论上称为状态犯,它没有不法行为的继续,因此不是继续犯。
