珠海人在土地管理方面是走过弯路的。在建立经济特区之前,珠海是一个仅有12万人口的小县。成为经济特区后,房地产业迅速发展,使这里的人们开始认识到土地的价值。于是,许多人把手伸向土地。但是,由于土地管理无章可循,多头分散征地、开发经营,无偿或低偿无限期使用土地,使国家土地资源严重流失。更深一层的问题是,对市政建设和基础设施建设,只有投入没有回收。从建市、办特区至1988年年底,市政府共投入人民币23亿元,借外资5500万美元,同时,还欠农民的征地和换地补偿款5.5亿元,但至1987年年底,对部分用地单位和三资企业回收市政配套和征收土地使用费仪2556.6万元。大量钱财都进了大大小小公司的“腰包”。“这样走下去,只有死路一条!”市委书记梁广大大声疾呼。他决心要改变这种过时的管理体制。那么,路在何方珠海市领导陷入了沉思。他们找来《中华人民共和国土地管理法》,看到了关于城乡地政统一管理的规定;他们参考省人大颁布实施的《深圳经济特区土地管理条例》的立法原则和方法,借鉴香港、澳门的经验,结合珠海实际,决定对土地高度集中管理,实行统一规划、统一征用、统一开发、统一出让和统一管理,实行有偿、有限期使用。
为此,珠海市人大常委会于1988年先后审议通过了《珠海市土地管理暂行办法》和《珠海市城市建设综合开发管理规定》,把对土地管理的“五个统一”,以政府规范性文件的形式确定下来并付诸实施。也就是从这个时候起,珠海市土地管理开始走上法治的轨道。
土地管理由乱到治,不是订立一两个规章就可以完成的。珠海市的实践表明,要依法治理,还必须进行艰苦的工作,冲破重重阻力。于是,珠海开始了对过去乱批乱用土地的清理整顿。他们全面清理非农建设用地,严肃查处违法用地。对干部、职工非法买地建房依法按章分别作了处理。18家房地产开发公司的情况也查清了,取缔了其中的14家,保留的4家也隶属市政府直接管理。这些公司过去征了未用的4200多亩土地也被收回了。通过大力整治,彻底结束了土地管理中的混乱状态。
但是,由于利益攸关,整治的阻力也是很大的。依法查处违章建设的淇澳新村32栋私人别墅一事便是典型。90年代初期,一些外地人向淇澳村委会申请在淇澳岛的淇澳新村兴建私人住宅。村委会同意后,他们未经规划和国土部门批准,未申办建房手续,便先后建起了30多栋三层小别墅。珠海市规划局、国土局于1994年10月先后两次在《珠海日报》上刊登“通知”,责令这些小别墅的主人在规定期间内补办报建手续。但是,规定的时限过去了,这些屋主没有任何反应。
“对这些违章者动真格的!”珠海市有关领导决定抓住这个藐视法规的典型。1995年5月30日,市规划局、国土局联合发出行政处理决定书,要依法没收32栋违章建筑的私人别墅,并在《珠海日报》公告送达。这一下全珠海都震动了,违章建筑行为自此大为收敛。
经过了几个回合,珠海人从依法管理土地中尝到了甜头,决心坚定不移地走下去。
1997年,市人大审议通过和颁布了《珠海市房地产登记条例》,国土局向市政府递交了《珠海市房地产抵押管理条例》(草案),《珠海市土地管理条例》亦将上报市政府。这个把“五个统一”明确从规章上升为法律条文的文件,也将很快由市人大审议。珠海市1997年出台了12个地方性法规,其中土地管理就占了3个,可见市政府和市人大的高度重视。珠海市土地管理完完全全纳入法治的轨道,为时不会太远了。
