(2) 在融资租赁关系中,出租人、出卖人、承租人可以约定,出卖人不履行买卖合同义务的,由承租人行使索赔的权利。故甲公司有权直接向丙公司主张合同标的。
(3) 不符合法律规定。在融资租赁合同中,无正当、充分的理由承租人不得解除合同。
(4) 甲公司经理王某不能以该设备为其妻弟的合同作抵押担保。根据公司法的规定,公司经理不能以公司资产为公司股东或其他个人作担保。何况该设备的所有权属于乙公司所有。
