材料一 中国是世界上遭受反倾销最大的受害国。据有关部门估算,中国出口产品遭受国外反倾销每年平均损失800多亿元人民币,并且导致大量相关企业人员下岗。随着中国成为第三世界贸易大国,未来20年将是中国企业应诉国外反倾销的高峰期。详见下图。

请结合上述材料,说明我国应怎样利用世贸组织的争端解决机制维护自己权益?

面对入世后于“特保条款”带给中国反倾销损害,我国企业和政府应在世贸组织的原则框架下做出如下努力:

(1)对企业来讲,第一,面对国外的反倾销诉讼,我国企业首先应积极应诉,按照世贸组织的有关规则来维护自身合法权益;第二,我国企业应加强对世贸组织有关规则的学习和研究,尤其是应对“绿色壁垒”等贸易保护主义障碍,需要认真思索;第三,企业应提高自身产品的科技含量和质量,提高服务水平,以高质量的产品和良好的服务赢得国际市场。

(2)在应对反倾销的挑战中,应积极采取有效措施以降、减少反倾销的发生及危害。首先,政府应继续推动国内市场经济体制的改革,深化国有企业改革,为企业发展创造良好的国内环境;其次,强化市场主体的法律意识和诚信观念,建立良好的社会信用制度;再者,政府部门应加紧对出口企业进行相关教育,促进同行业内相关企业的合作,同时协调企业间的行动。最后,中国政府应在国际市场经济国家之间主动地沟通、合理游说,为解决贸易纠纷创造良好条件。
